Views (Voice) of the Child Reports
Now more than ever, children want to be heard! This service is a helpful way for children to have a voice in their world that has been turned upside down by a separation/divorce. A Views of the Child Report often promotes settlement in a family court matter. This service is relatively non-intrusive, inexpensive and brief (approximately 3 to 4 weeks), in comparison to a Custody and Access Assessment and Report, and can be court-ordered, or agreed to by the parents.
The process typically involves reviewing relevant court documents and conducting interviews with each child over several weeks. The children’s views and preferences are canvassed about a number of subjects within the separation and divorce framework. A brief Report is then completed, and provided to the parents and, if applicable, their counsel and court.
Lawyers or parents may make referrals for this service. For work to commence, parents will be required to sign a Views of the Child Report Retainer Agreement and provide a retainer. In some circumstances, such as families with very young or certain special needs children, or when children have not had an ongoing relationship with a parent, other services may be more appropriate.
